REMEDIES FOR COPYRIGHT INFRINGEMENT

(1) Injunctive relief/preliminary injunction for infringement

A copyright owner may file a request for prohibition on or prevention of infringement against any person who infringes or is likely to infringe his copyright.

(2) Claim for compensatory damages

A copyright owner may claim for damages against any person, who has, intentionally or negligently, infringed his copyright.

(3) Criminal liability for copyright infringement

Copyright infringement with respect to an economic right constitutes a crime punishable by imprisonment for not more than five (5) years or by a fine not exceeding KRW 50 million, and copyright infringement with respect to a moral right is a crime punishable by imprisonment for not more than three (3) years or by a fine not exceeding KRW 30 million.
